Study Circle on Competition and Innovation
During his time at the University of Tübingen Professor Bien founded the Study Circle on Competition and Innovation. The Study Circle periodically brings together academics with practitioners and enables them to exchange views on recent developments in competition law, competition theory and competition policy. Inter alia, the Study Circle focuses on innovation policy aspects of competition law application, i. e. in particular, the relation between competition law and the protection of intellectual property.
The members of the Study Circle are scholars and university professors at various European universities and research institutes. Practical experience of the participating judges, lawyers and members of national and European competition authorities provides for a strong connection with the praxis of German and European competition law application. The interdisciplinary approach is served by including economists as well, e. g. of the ZEW (Centre for European Economic Research), Mannheim.
"The Implementation of the EU Antitrust Damages Directive"
The 10th study-day took place on Friday, 5th May 2017, at the University of Würzburg. The English-language seminar was devoted to the implementation of the EU damages directive into national law by five important member states, France, Germany, Italy, the Netherlands and the United Kingdom. Every jurisdiction was represented by two speakers. The seminar focused on the following topics:
- Disclosure of documents that lie in the control of the parties,
- Disclosure of evidence included in the file of a competition authority,
- Limitation periods,
- Binding effect of decisions of national authorities,
- Effect of consensual settlements on subsequent damages actions.
